Terms and Conditions of Participation - Contest - Websites / Social Media
1. Organizer
The organizer of this contest is Danone Schweiz AG, Hardturmstrasse 135, 8005 Zurich, Switzerland, hereinafter referred to as Danone Schweiz AG.
2. No connection with social networks
This promotion is not associated with Facebook or Instagram in any way and is not sponsored, endorsed, or organized by them. The recipient of the information provided by the participant is not Facebook or Instagram, but Danone Schweiz AG. Furthermore, Facebook or Instagram is not available as a contact for the contest. The participant releases Facebook or Instagram from all claims.
3. Eligibility
Eligible participants are individuals residing in Switzerland, who are at least 18 years old at the time of participation. Employees of Danone Schweiz AG, their relatives, and all individuals involved in the conception and implementation of this contest are excluded from participation. The participant of the contest is the person who owns the email address/social media account provided during the contest registration. Each participant is only allowed one entry in this contest. Participation using automated data processing processes and/or the involvement of third parties (e.g., contest agencies) is prohibited. Any improper participation by a participant in this contest will result in their disqualification. Participation is free and independent of the purchase of goods or services. By participating in the contest, the user accepts these terms and conditions. To participate in the contest, the participant must scan the QR code on the evian bottles or on social media. Afterwards, they will be redirected to the website. There, they can play the contest via the participation link. Then, they must fill out a form with their name, first name, and email address.
4. Prizes
Only the prizes specifically described in the contest will be awarded. As part of the contest from 01.05.2024 – 30.06.2024, the following prize will be drawn: 1x2 VIP tickets for the Swiss Open in Gstaad. Ticket value: 450-650 CHF depending on the event day. The winner is responsible for the costs of transportation, accommodation, and meals during this time. As part of the contest from 01.07.2023 – 31.12.2024, the following prize will be drawn: 2x1 evian Goodie Bag [Value: 100 CHF]. The prizes will only be awarded to participants who have completed all the input fields required for participation in the contest fully, clearly, and correctly. The contest starts on [01.05.2023] and ends for the Swiss Open Gstaad tickets on [30.06.2024] and for the Goodie Bag on [31.12.2024]. The winners will be selected by random draw from all correct entries. A cash payment of the material values or exchange of the prizes is not possible. The prizes are not transferable. Danone Schweiz AG is entitled to change the awarding of the prizes.
5. Notification of Winners
The winner(s) of a prize will be notified promptly using the address details and information provided during registration. Winners will be notified of the prize after the end of the contest via private message (from Danone Schweiz). The winner must confirm receipt of the prize notification to Danone Schweiz AG immediately, but no later than within 7 calendar days, and provide the information required by Danone Schweiz AG to hand over the prize. Otherwise, Danone Schweiz AG is entitled to determine a new winner by drawing lots or to let the prize expire. The formalities for the handover of the main prize will be clarified individually with the winner, unless this is already evident from the announcement of the contest. Usually, an attempt at delivery will be made. The winner is responsible for any travel expenses to and from the prize-giving ceremony, as well as any additional travel, food, and accommodation costs that may arise. If the prizes consist of movable property, they will be sent to the winner by post to the address provided during registration. Delivery is free within Switzerland. Any additional transport costs and customs duties are the responsibility of the winner. Despite assuming the shipping costs, the place of performance remains Hardturmstrasse 135, 8005 Zurich, Switzerland.
6. Rights
The participant assures that the submitted contribution is their own, has not been submitted, published, or awarded elsewhere, or, at least, that they have all necessary rights to the submitted contribution and that it does not violate good morals, applicable law, or the rights of third parties. If violations of the aforementioned cases occur, Danone Schweiz AG will immediately delete the submitted contribution. Furthermore, Danone Schweiz AG reserves the right to delete all contributions that, in the opinion of Danone Schweiz AG, contain offensive or inappropriate content at any time and without giving reasons. If third parties nevertheless hold Danone Schweiz AG liable for infringement of rights by a submitted contribution, the participant indemnifies Danone Schweiz AG from these claims and the costs of the associated legal defense. In addition, each participant grants Danone Schweiz AG an unrestricted, spatially, temporally, and content-wise exclusive right of use to the submitted contributions, free of charge.
7.
The decisions of Danone Schweiz AG are final. Related inquiries cannot be answered. Danone Schweiz AG reserves the right to suspend the contest entirely or temporarily if any circumstances arise that jeopardize the integrity of the contest or contradict legal reasons.
8.
Danone Schweiz AG also reserves the right to change the terms and conditions of participation at any time.
9.
Any liability of Danone Schweiz AG and its organs, employees, and agents arising from or in connection with the contest, regardless of the legal basis, is limited to cases of intent or gross negligence, to the extent permitted by law.
10.
Swiss law applies. The legal process is excluded.
